Obama wants Russia trade vote before WTO deal: trade official (Reuters)

WASHINGTON (Reuters) ? President Barack Obama wants Congress to approve "permanent normal trade relations" with Russia this year, before the former Cold War enemy finishes its negotiations to join the World Trade Organization, a U.S. trade official said on Wednesday.

"It's clear that Russia's ambition is to complete the accession process and become a WTO member by the end of the year," said Chris Wilson, assistant U.S. trade representative for the WTO and multilateral affairs.

"Our focus is on trying to achieve a vote before" that happens, Wilson said during a panel discussion of remaining issues blocking Russia's entry into the world trade body.

Wilson said it was important that Congress approve permanent normal trade relations, or PNTR, before a final WTO accession deal is reached to ensure U.S. exporters immediately get the full benefits of Russia's entry, which could occur this December at a WTO ministerial meeting.

If lawmakers fail to approve PNTR and revoke a Cold War-era provision known as the Jackson-Vanik amendment, WTO rules would allow Moscow to deny the United States the new access it has negotiated in the Russian market while providing it to other WTO members, he said.

But many lawmakers see a vote on PNTR as a proxy for a vote on Russia's WTO accession and have resisted past efforts to approve PNTR before a final WTO deal is struck.

They have taken that line even though Jackson-Vanik was originally passed to encourage Russia to allow Jews to emigrate freely, and Washington has judged Moscow to be in compliance with that requirement since 1994.

In addition, concern over Russia's record on human rights and its commitment to the rule of law are expected to enter into the debate on PNTR, requiring the Obama administration to mount a major lobbying effort with Congress if it serious about winning approval, one congressional aide said.

WINDOW OF OPPORTUNITY

Although talks on Russia's bid to join the WTO have taken years, Wilson said Moscow appeared to see a window of opportunity to finish the process this year, before the 2012 Russian presidential election.

"It's certainly plausible and conceivable to us" that a final deal can be reached in 2011, Wilson said.

Russia has already made a lot of progress on that front but two big remaining issues involve how Russia will harmonize its food, plant and animal import safety rules with global standards and Russian rules for investing in the automotive sector that have raised some concern, Wilson said.

Separately, Russia must consolidate all the tariff cuts it agreed to make in bilateral negotiations with the United States and some 50 other WTO members into a single tariff schedule.

Related to that, Russia hopes to finish negotiations this month with the United States, the EU, Australia, Brazil and other WTO members on new tariff-rate quotas for imported poultry, pork and beef, Wilson said.

Washington also wants further evidence Moscow is serious about enforcing intellectual property rights, he said.

Russia has been working to resolve trade concerns with Georgia, with which it fought a brief war in 2008, so the Caucasus nation will not block its entry into the WTO.

"We are very supportive of that effort," Wilson said, noting the Swiss government has played an important role in shuttle diplomacy between the two.

Newt and Callista GingrichGOP presidential hopeful Newt Gingrich has problems. His senior campaign staff recently resigned en masse. His poll numbers are low, and his unfavorability ratings are high. And he's become a figure of delighted derision in light of news that he held at least two lines of credit?one for as much as $1 million?with the high-end jeweler Tiffany & Co. How do you get such a line of credit? And was Gingrich getting a sweetheart deal on his blue-boxed diamonds?

Gingrich has released as little information as possible about his accounts and what they bought. Last month, Politico reported that Gingrich owed up to half a million dollars to Tiffany's in 2005 and 2006, based on personal financial disclosure forms his wife, Callista, filed when she was working for the House Agriculture Committee. The public filings show that in both years, Newt owed Tiffany's between $250,001 and $500,000 via a "revolving charge account." Gingrich described as the account as a "standard no-interest account."

This week, Gingrich's campaign announced that his own financial disclosure forms would show that the family also had a second line of credit with the jeweler. A Gingrich spokesman told Chris Cilizza at the Washington Post that "the Gingriches had a $500,000 to $1 million line of credit at Tiffany's" adding that it "has a zero balance, and it has been closed."

So what kind of deal were the Gingriches getting? Let's start with the first line of credit. In her disclosure forms, Callista Gingrich describes the six-figure debt as a "revolving charge account." This is not a "standard no-interest account," as Newt asserted. It is a credit card, and Tiffany's happily offers creditworthy customers cards with state-specific rates. The Gingriches have homes in Georgia and northern Virginia. In both of those states, the annual APR on a Tiffany's charge account is an eye-watering 21 percent.

The disclosure does not make clear just how much was spent or when. The Gingriches could have charged $250,001 to $500,000 and then carried the balance from year to year, accruing more than $30,000 in interest. They could have charged and later paid off between $250,001 and $500,000 of jewelry in both years. Or they could have done some combination thereof.

But the fact that Newt described the account as "no interest" is mysterious. Did the Gingriches get a reprieve on interest payments from Tiffany's? Or was Newt confused or obfuscating about the account?

Statements from Tiffany's clarify a bit: The Gingriches had both a credit card and an interest-free line of credit with the company?the "standard no-interest account" seems to be the one announced more recently. Indeed, Tiffany's offers yearlong interest-free loans to borrowers who spend more than $1,000 on an engagement ring or $5,000 on other Tiffany pieces, provided that they have good credit and that they are already Tiffany credit card holders.

The company calls them Tiffany Time Accounts, and while it does not advertise them on its website or in promotional materials, it readily offers them in-store to goose customers to buy more expensive engagement rings or other baubles. Still, Gingrich fudged the explanation a bit?these are not normally "revolving funds," as he initially said. The store requires payment within a year. (Of course, Gingrich could have had a special understanding. On that point, he has not clarified.)

Such premium payment options are not uncommon at Tiffany's or other high-end jewelers. (You, too, could get a seven-figure loan from Tiffany's, provided you had good enough credit and were buying pricey enough pieces.) Many swanky stores and luxury chains offer financing, in the form of interest-free loans, standard loans, and credit cards. They also cut sweetheart financing deals for their best customers or for celebrities and other VIPs. There's nothing illegal or unusual about it.

Gingrich protests that the lines of credit imply nothing extraordinary about him. He insisted to Face the Nation that he's just a "guy running for president who pays all of his bills" and that he lives a "very frugal" life.

But the Gingriches spent, at a bare minimum, $750,000 on Tiffany pieces. There is the distinct possibility they paid an amount equivalent to the median American's salary just on interest to Tiffany's. That hardly seems frugal.

An Interview with Rachel Devenish Ford, author of The Eve Tree

There is a gentle fragility about Rachel, or Rae as most people call her. She is vulnerable in the strongest way possible, wearing her heart on her sleeve. We've known each other since we were single, she was 18, I was 20, and we traveled the west coast of Canada and the US in a giant 16 passenger van with 4 other girls. It was a pivotal year for us both and we grew up together in the ways that really matter.

I was there the day her husband fell for her reading a poem she wrote about an orange. Words so sensual, so intimate that he says he was immediately drawn in.

Rae's blog Journey Mama is a sensory adventure into her life traveling the globe with her family, rich with photos and words that take you there. Last month she at last published her book The Eve Tree, to the delight of her devoted readers.

Thanks to the wonders of modern technology, I was able to interview her at her current home in Pokhara, Nepal from my home in San Diego county. She confided that this is the first time she's been interviewed, which seems fitting considering our history of shared pivotal moments.

You are a mother, you live in India and change houses, not to
mention countries, every 6 months or so, and you home school 4 kids. How did you find time to write a novel? How long did it take you?

Writing The Eve Tree took me almost four years. There were many interruptions. During the span of time that I was writing it, I moved to India, had a baby, did lots of traveling, and yes, homeschooled.

Madeleine L'Engle wrote about the time when your kids are in school as prime writing time. Not the time to do housework, she said. I remember reading that and thinking, "I'm a level up from that". My kids don't go to school, so I have to work harder to find time.

I don't know why I have this drive to be a novelist, but I do, so my life has to take on quite a disciplined shape. Most of my writing I do in the mornings before the kids wake up. I'm up at 5:30, writing, which means I have to be in bed by 10:00 or 10:30. I am almost in a trance when I write. I don't have time for procrastination or futzing around, so as time has gone on, I've honed the practice of sitting down, looking at the page, and diving in.

When I'm editing, I need longer stretches of time to concentrate. I have a supportive husband (with a flexible schedule) who helps me to get a day or two a week to fully devote to writing in these times.

I can't work at night, but in the evenings I read other books, read over my manuscript, or dream about it. Everything I do with my spare time has to do with reading or writing. No TV, a rare movie. I also live in a community and have a lot of events to be part of. It's always a challenge to make room for writing time.

One of the biggest challenges in writing this book was language. Living in an international community, I hear so many different types of English everyday. British English, Indian English... I worked really hard to keep the language local to the place and not put any words like persnickety in there.

You write a blog called Journey Mama about your travels with your family. Could you tell us a bit about it?

When I started Journey Mama in 2005, mine was a figurative journey, as my family was planted in Northern California. In 2008 we moved to Goa, India, and have been traveling ever since. There are six months every year that we are in Goa, and beyond that it's always an adventure.

I see my blog as a way to tell my own story. I find that circumstances have a way of rolling us over and beating us over the head, but we can choose to become authors of our lives. Taking the events of the day and weaving them into a story gave me a lot of power when I started the blog. I was 25 and pregnant, living in a 280 sq ft cabin in the woods with my husband and two kids, and feeling mightily sorry for myself. I needed to rewrite the story

Patent Law Practice Center - PLI ? Supreme Court Grants Certiorari ...

On Monday, the United States Supreme Court agreed to consider whether to set limits on when inventors can patent medical diagnostic tests. ?Our friends at Foley & Lardner sent in this article discussing the history of the case, the issues being considered by the Court and the potential impact this case may have on intellectual property in the personalized medicine space.

On June 20, 2011, the United States Supreme Court granted Mayo?s petition for certiorari in?Prometheus Laboratories, Inc. v. Mayo Collaborative Services, 628 F.3d 1347 (Fed. Cir. 2010), a case addressing patent eligibility under 35 U.S.C. ? 101 of certain method claims relevant to personalized medicine. While the issue under consideration here does not relate to whether isolated genes and other alleged ?products of nature? are patent-eligible, the Court in?Prometheus will likely address whether and how one can claim methods that take advantage of correlations between an individual?s personal health/genetic make-up and possible health care options.

As discussed in postings on Foley?s Personalized Medicine Bulletin and PharmaPatents blogs, Mayo Collaborative Services filed a second petition for certiorari with the Supreme Court after the Federal Circuit upheld the claims (for a second time) on remand after the Supreme Court?s decision in?Bilski v. Kappos (2010). Representative claims in?Prometheus include:

Claim 1 of?U.S.?Patent No. 6,355,623:

1.?A method of optimizing therapeutic efficacy for treatment of an immune-mediated gastrointestinal disorder, comprising:

(a)?administering a drug providing 6-thioguanine to a subject having said immune-mediated gastrointestinal disorder; and

(b)?determining the level of 6-thioguanine in said subject having said immune-mediated gastrointestinal disorder,

wherein the level of 6-thioguanine less than about 230 pmol per 8?108 red blood cells?indicates a need to increase the amount of said drugsubsequently administered to said subject and

wherein the level of 6-thioguanine greater than about 400 pmol per 8?108 red blood cells?indicates a need to decrease the amount of said drug subsequently administered to said subject.

Claim 46 of?U.S.?Patent No. 6,680,302:

46.?A method of optimizing therapeutic efficacy and reducing toxicity associated with treatment of an immune-mediated gastrointestinal disorder, comprising:

(a)?determining the level of 6-thioguanine or 6-methylmercaptopurinein a subject administered a drug selected from the group consisting of 6-mercaptopurine, azathioprine, 6-thioguanine, and 6-methyl-mercaptoriboside, said subject having said immune-mediated gastrointestinal disorder,

wherein the level of 6-thioguanine less than about 230 pmol per 8?108 red blood cells?indicates a need to increase the[] amount of said drugsubsequently administered to said subject, and

wherein the level of 6-thioguanine?greater than about 400 pmol per 8?108 red blood cells or a level of 6-methylmercaptopurine greater than about 7000 pmol per 8?108 red blood cells?indicates a need to decrease the amount of said drug subsequently administered to said subject.

In its December 2010 decision, Federal Circuit held that both the ?administering? and ?determining? steps were transformative and not merely data-gathering steps. (See Foley?s Legal News Alert: Chemical, Biotechnology & Pharmaceutical and PharmaPatents blog.) Specifically, the method claims recited a patent-eligible application of naturally occurring correlations between metabolite levels and efficacy/toxicity, i.e., the treatment of a specific disease by administering specific drugs and measuring specific metabolites. As noted by the court, ?[t]he invention?s purpose to treat the human body is made clear in the specification and the preambles of the asserted claims.? Thus, the method did not wholly preempt all uses of the recited correlations. The methods were not ?merely? data-gathering steps or ?insignificant extra-solution activity,? but rather were part of treatment regimes, and therefore involved ?a significant transformative element.?

The Supreme Court?s decision to grant certiorari today means that the Court may finally provide some additional clarity regarding the best way to pursue and enforce diagnostic method patent claims in light of patent eligibility considerations under 35 U.S.C. ?101. In this context, many wonder if Justice Breyer will finally have an opportunity to give precedential force to views he expressed in his dissent in?Lab. Corp v. Metabolite, 126 S.Ct. 2921 (2006), suggesting patent ineligibility of certain diagnostic claims.

In fact, on June 6, 2011, Justice Breyer referenced his?Metabolite opinion in his dissenting opinion in?Board of Trustees of Leland Stanford Junior University v. Roche Molecular Systems, Inc., holding that the Bayh-Dole Act does not automatically vest title of federally funded inventions to federal contractors (e.g., universities). (See Foley?s Legal News Alert: Intellectual Property and PharmaPatents blog.) In the context of his dissent in the?Stanford v. Roche case, Justice Breyer states:

[P]atents themselves have both benefits and costs. Patents, for example, help to elicit useful inventions and research and to assure public disclosure of technological advances. [citing?Bilski and other cases] . . . But patents sometimes mean unnecessarily high prices or restricted dissemination; and they sometimes discourage further innovation and competition by requiring costly searches for earlier, related patents or by tying up ideas, which, were they free, would more effectively spur research and development.

Citing the Founding Fathers, Justic Breyer continued:

Thus, Thomas Jefferson wrote of ?the difficulty of drawing a line between the things which are worth to the public the embarrassment of an exclusive patent, and those which are not.? . . . And James Madison favored the patent monopoly because it amounted to ?compensation for? a community ?benefit.?

It is worth noting that claims in?Prometheus differ from those in?Metabolite. Claim 13 in U.S. Patent No. 4,940,658 is a representative claim at issue in?Metabolite:

13.?A method for detecting a deficiency of cobalamin or folate in warm-blooded animals comprising the steps of:

assaying a body fluid for an elevated level of total homocysteine; and

correlating an elevated level of total homocysteine in said body fluid with a deficiency of cobalamin or folate.

It is possible that claims at issue in?Prometheus differ enough from claim 13 to alleviate Justice Breyer?s concerns regarding ?the embarrassment of an exclusive patent.? If Justice Breyer believes the claims are not different enough, however, and enough Supreme Court Justices agree with Justice Breyer, and?Prometheus is reversed, the impact could be far-reaching, encompassing many personalized medicine and diagnostic method inventions. Because these areas are viewed by many as the next frontier in medical advances and health care, many will believe that such a result would unwisely discourage innovation in this important area by weakening patent rights. On the other hand, those who view patents as an impediment to research will believe that such a Court decision would promote innovation by making the advances open to all.

In short,?it remains to be seen what Justices Breyer and Ginsburg, and the rest of the Justices, might do with the claims at issue here in?Prometheus. Regardless, this case stands to have a large impact on intellectual property in the personalized medicine space.
